Three Important Kansas Workers’ Compensation Deadlines

Kansas workers’ compensation law sets strict deadlines for reporting injuries and pursuing benefits. Missing one can put your claim at risk, so it is important to understand these three key time limits.

Deadline 1—Report the Injury

Report it right away, and put it in writing. Don’t wait to see if it gets better.

Bajo K.S.A. 44-520, the outside limit is the earlier of:

  • 30 calendar days from the date of the accident or repetitive trauma injury, or
  • 20 calendar days after your last day of work for that employer

Notice can be spoken or written, but it has to include the time, date, and place of the injury; who was hurt; and what happened, and it has to be clear that you’re claiming workers’ compensation benefits or reporting a work-related injury. Telling a coworker you’re sore is not notice.

Give it to a supervisor or manager. In writing is better because if there’s a dispute about written notice, the burden is on you to prove it was received.

Deadline 2 — File The Claim

Reporting your injury is not the same as formally pursuing workers’ compensation benefits. Under K.S.A. 44-534, you generally must file an application for hearing within tres años of the accident or dos años after the last payment of compensation, whichever is later.

Waiting too long can jeopardize your ability to pursue benefits. If your claim has been denied or payments have stopped, consider getting legal guidance about the deadline that applies to your circumstances.

Deadline 3 — The One Everybody Misses

If someone other than your employer caused your injury, you have a separate negligence claim against them. That claim is where the money for pain, suffering, and the long-term effect on your life comes from. Workers’ comp doesn’t pay for any of that.

In Kansas, under K.S.A. 44-504, you generally have one year from the date of injury to file that lawsuit. For a family bringing a claim after a work-related death, it’s 18 months.

If you don’t file in time, that cause of action is assigned to your employer, and your employer can pursue it instead of you.

One year. That’s the deadline that costs Kansas workers the most money, and it runs while you’re still in treatment and still waiting on the comp insurer.

If a motor vehicle collision caused your workplace injury, you may also have options through a car accident claim. If you were hit by a vehicle, hurt by another contractor on a jobsite, or injured by defective equipment, call a Kansas workers compensation lawyer well before that year is up.

Choosing a Doctor for Your Kansas Work Injury

Under Kansas law, your employer is generally responsible for providing reasonably necessary medical treatment for a workplace injury. If you are injured at work, understanding who can authorize your care is important.

Can You Choose Your Own Doctor?

In most cases, your employer or its workers’ compensation insurance carrier arranges the authorized medical care. However, if you are dissatisfied with the treatment provided, you may apply to the Kansas Director of Workers’ Compensation for authorization to change providers. The process generally allows you to choose from two providers submitted by the employer, subject to the applicable rules.

You may also consult your own doctor without prior approval, but the employer’s liability for that care is generally limited to $800 in total under K.S.A. 44-510h. Important restrictions apply, including limits on using that visit to obtain a functional impairment rating for your workers’ compensation case.

Before paying for treatment yourself or changing doctors, understand how the decision could affect your claim. A Kansas workers compensation lawyer can help you review your options and the rules that apply to your medical care.

Kansas Workers’ Compensation Benefits

A workplace injury can affect more than your health. For workers in Kansas City, Wichita, and surrounding communities, an accident on a construction site, in a warehouse, or while making deliveries by commercial trucks along busy routes such as I-70 and I-35 can also mean missed shifts and lost income.

Kansas workers’ compensation may provide medical care and wage-replacement benefits when an employee qualifies. Depending on the injury and its effect on the worker’s ability to earn wages, additional disability or death benefits may also be available. The amount depends on the applicable law, earnings, and type of benefit.

Kansas Workers’ Compensation Weekly Benefit Rates

For injuries occurring from July 1, 2026, through June 30, 2027, Kansas lists the following workers’ compensation benefit levels:

Benefit Amount
Maximum weekly benefit $905
Minimum weekly benefit $50
Minimum weekly survivors’ benefit $603
Private automobile mileage reimbursement rate $0.70 per mile*

The mileage rate is based on Kansas Department of Administration guidance effective January 1, 2026. Confirm how the rate applies to a particular workers’ compensation claim before relying on it.

These figures are statutory benefit levels, not guaranteed payments. The amount an injured worker receives depends on the applicable benefit category, wage calculation, and eligibility requirements. Mileage reimbursement may be subject to separate rules.

Kansas Workers’ Compensation Benefit Limits

Kansas law also places limits on certain categories of compensation. The applicable limit depends on the type of disability or claim.

Benefit category Statutory limit
Permanent total disability, including certain prior disability payments $400,000
Temporary total disability, including certain prior disability payments $225,000
Temporary or permanent partial disability $225,000
Permanent partial disability based on functional impairment only $100,000
Death benefits for eligible dependents Up to $500,000
Death benefits when there are no dependents Generally $100,000 to legal heirs, subject to statutory requirements

These limits apply under specific statutory conditions and should not be treated as the amount every worker or family will receive. The calculation and eligibility rules matter, and certain prior payments may count toward a limit.

If you work in Kansas City or elsewhere in Kansas and your benefits have been delayed, denied, or calculated incorrectly, a Kansas workers compensation lawyer can review your circumstances and explain which benefits and limits may apply.

How Much Does a Kansas Workers’ Compensation Lawyer Cost?

Under Kansas law, attorney fees in an original workers’ compensation claim are subject to statutory limits. Under K.S.A. 44-536, the fee generally cannot exceed a reasonable amount or 25% of the compensation recovered and paid, whichever is less. Actual expenses may also apply, and the attorney fee arrangement is subject to the required approval process.

Before proceeding with a claim, ask how attorney fees and case-related expenses will be handled. Understanding the arrangement upfront can help you make an informed decision about your options.

FAQs About Kansas Workers’ Compensation!

Can My Employer Require Me to Attend an Independent Medical Examination in Kansas?

Yes. Under Kansas law, an employer can request an examination by a healthcare provider it selects. Refusing a required examination may suspend benefits until you comply. If you have concerns, understand your obligations before missing or declining an appointment.

What Happens if My Employer Offers Me Light-Duty Work After a Workplace Injury in Kansas?

Your medical restrictions and the duties offered will matter. If your employer offers modified work after an injury in Kansas City or elsewhere in the state, review the job requirements with your treating provider before accepting duties that may conflict with your restrictions.

What Happens if I Live in Missouri but Work in Kansas?

If you live in Missouri but work in Kansas, you may qualify for Kansas workers’ compensation benefits, depending on your employment and injury circumstances. A Missouri workers’ compensation lawyer can help you understand which state’s laws may apply to your claim.

Does Kansas Workers’ Compensation Cover Injuries Caused by Repetitive Work Activities?

Potentially. Repeated lifting, forceful movements, or other job-related activities may cause repetitive-trauma injuries. Kansas law requires specific medical evidence and a connection between the employment-related risk and the injury. The legal requirements differ from those for a sudden workplace accident.

What Can I Do if My Employer Disputes My Medical Work Restrictions in Kansas?

If your employer challenges restrictions recommended by your healthcare provider, keep copies of medical records and written restrictions. Kansas law provides a process for certain neutral medical examinations during claim disputes. Understanding that process may help clarify your diagnosis, treatment recommendations, and temporary work limitations.
