Thirty percent at fault on a $100,000 claim means $70,000. Now think like the insurance company. The cheapest outcome for them is not a small settlement. It is pinning half the blame on you and paying nothing at all. So the adjuster will ask about your speed, your phone, your last drink, whether you &#8220;could have avoided it.&#8221; Every one of those questions is aimed at a percentage.<\/p>\n<p>That is why the first days matter. Event data recorder downloads, intersection and business camera footage, skid measurements, witness contact info. All of it disappears fast, and most cameras overwrite within days.<\/p>\n<h2>The deadlines are shorter than you think<\/h2>\n<ul>\n<li>Most Nebraska injury claims: four years from the date of the crash (Neb. Rev. Stat. \u00a7 25-207).<\/li>\n<li>Wrongful death: two years from the date of death, filed by the estate&#8217;s personal representative (Neb. Rev. Stat. \u00a7 30-810).<\/li>\n<li>Crash involving a city, county, school district, or other political subdivision: written claim within one year, and the lawsuit must be filed within two years (Neb. The four-year deadline does not apply to these claims.<\/li>\n<li>Crash involving a State of Nebraska agency or employee: a separate claims process with its own shorter deadlines applies.
